These Terms are an agreement between you and Kenya Home Search ("we", "us"), which operates the website at www.kenyahomesearch.com and its related services (the "Platform"). By creating an account, listing a property, sending an enquiry, buying a package or otherwise using the Platform, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Platform.
You must be at least 18 years old and able to enter a binding contract.
1. What we do, and what we do not do
1.1 Kenya Home Search is an online property advertising and search platform. Owners, landlords, agents, developers and land sellers ("Listers") advertise property on it, and people looking to rent or buy ("Seekers") find those adverts and contact the Lister directly.
1.2 We are not an estate agent, broker, property manager, valuer, surveyor or advocate. We do not act for any Lister or Seeker, we do not negotiate, show property, hold deposits, collect rent or purchase money, or take any commission or success fee on a sale or letting. Any agreement to rent or buy is made only between the Lister and the Seeker.
1.3 We earn money only from advertising and platform services: listing packages, add-ons, promoted placement and the verification and media services described on the Platform.
1.4 We will never ask you to pay a deposit, viewing fee, booking fee or any purchase or rent money to us or through us. If anyone asks you to pay such money to "Kenya Home Search", it is a scam. Report it to enquiries@kenyahomesearch.com.
2. Accounts
2.1 Give accurate information and keep it up to date. Keep your sign-in details private. You are responsible for activity on your account.
2.2 One person or business per account. Agents and agencies must use their own registered business details.
2.3 We may ask you to verify your identity, phone number, email or business registration before you can list, and we may limit features until you do.
3. Listers: your promises to us and to Seekers
3.1 By publishing a listing you confirm that:
you own the property or have the owner's written authority to advertise it, and can show that authority if we ask;
if you act as an estate agent for reward, you are registered with the Estate Agents Registration Board and hold a current practising certificate;
the listing is accurate and not misleading, including price, size, location, title status, availability and photos, videos and tours, which must be of the actual property unless clearly labelled as illustrative;
you will update or remove the listing as soon as it is let, sold or withdrawn;
the listing and your dealings with Seekers comply with Kenyan law, including the Land Act, the Land Registration Act, the Consumer Protection Act and the Data Protection Act.
3.2 You must not: list property you are not authorised to market; ask Seekers for viewing fees or for money before a verified viewing and proper documentation; discriminate unlawfully against Seekers; post duplicate or bait listings; or use Seekers' contact details for anything other than replying to their enquiry.
3.3 You are responsible for your dealings with Seekers, including any agreement, payment and handover.
4. Seekers: your responsibilities
4.1 Listings are provided by Listers. Before paying any money or signing anything you should: view the property in person or through someone you trust; confirm the Lister's identity and authority; for land and purchases, carry out an official search on Ardhisasa and use your own advocate; and pay only through your advocate's client account or a traceable bank channel, never cash to an individual.
4.2 Use Lister contact details only to enquire about the property.
5. Verification, badges and checks
5.1 Some listings and accounts show badges such as "ID verified", "Verified owner", "Boundary checked" or "Diaspora-ready". Each badge means only the specific check described on the Platform at the time it was given, for example that a moderator compared an identity document with the account, or an outline with a survey plan the Lister supplied, or that an official search returned the stated details on the stated date.
5.2 A badge is not a legal opinion, a valuation, a survey, a guarantee of title, or a recommendation to buy or rent. Records can change after a check, and checks rely on documents and registries we do not control. Always carry out your own due diligence as set out in clause 4.1.
5.3 We may remove a badge at any time if we have reason to doubt the information behind it.
6. Promoted placement
6.1 Listers can pay for promoted placement (boosts and "Featured" status). Promoted listings appear higher in the default "Recommended" order and are always labelled "Featured" where shown as such. Promotion only changes order within results the listing already matches; it does not change search filters or counts. Sorting by newest or price ignores promotion.
6.2 Promotion is not an endorsement of the listing or the Lister.
7. Packages, fees and payment
7.1 Prices for packages and add-ons are shown on the Platform in Kenya shillings and include any applicable tax unless stated otherwise. We issue receipts and, where required by law, electronic tax invoices.
7.2 A package starts when we confirm your payment and runs for the term stated. Allowances (listings, photos, video minutes, tours, boosts) apply for that term and do not roll over unless stated.
7.3 Packages do not renew automatically. We will remind you before a package ends.
7.4 Refunds: you may cancel within 48 hours of payment for a full refund if you have not used any paid allowance. After that, fees are non-refundable except where we end your package without cause under clause 11.2, where the law requires a refund, or where a paid service was not delivered. Verification fees are for carrying out the check and are not refundable because the result is unfavourable.
7.5 We may change prices for future purchases. Changes never affect a package you have already paid for.
8. Content and licence
8.1 You keep ownership of the photos, videos, tours, text and documents you upload. You give us a non-exclusive, royalty-free, worldwide licence to host, copy, resize, display and share that content on the Platform, in search engines, in link previews when shared, and in our marketing of the Platform, for as long as the listing is live and for a reasonable period after to clear caches and archives. Survey files and identity documents are used only for the check you asked for and are never published.
8.2 You confirm you have the rights to everything you upload and that it does not infringe anyone's rights or contain personal data of others without a lawful basis.
8.3 We may edit listing formatting, remove personal contact details from descriptions, blur or remove content, or reject or remove listings that break these Terms or that we reasonably believe are inaccurate, fraudulent or unlawful.
9. Acceptable use
You must not: scrape or bulk copy listings or contact details; interfere with the Platform's security, rate limits or bot checks; upload malware; impersonate anyone; send spam through the Platform; or use the Platform for any unlawful purpose.
10. Reporting and takedown
Report a suspicious listing, a scam attempt or content that infringes your rights to enquiries@kenyahomesearch.com with the listing reference. We review reports promptly and may suspend a listing while we check it.
11. Suspension and ending your account
11.1 You may close your account at any time from your profile or by emailing us.
11.2 We may suspend or close an account, or remove listings, if you break these Terms, if we reasonably suspect fraud, or if the law requires it. Where we close a paying account without cause, we refund the unused part of the package.
11.3 Clauses 5, 8.1 (for the clean-up period), 12, 13 and 15 continue after an account ends.
12. Liability
12.1 The Platform is provided as is. We work to keep it available and accurate but do not guarantee that it will be uninterrupted or error free, or that any listing is accurate, available or lawful.
12.2 To the extent the law allows, we are not liable for: any loss arising from a transaction, agreement, payment or dispute between Listers and Seekers; the condition, title, legality or value of any property; the acts or omissions of any Lister, Seeker or third party; or any indirect or consequential loss, including loss of profit, opportunity or data.
12.3 Our total liability to you for all claims in any 12 months is limited to the greater of the fees you paid us in that period and KES 10,000.
12.4 Nothing in these Terms limits liability that cannot be limited under Kenyan law, including for fraud, or your rights as a consumer under the Consumer Protection Act.
13. Indemnity
If you are a Lister, you will compensate us for losses, claims and reasonable legal costs we incur because of your listings, your content, your breach of these Terms or your dealings with Seekers.
14. Changes to these Terms
We may update these Terms. We will post the new version with its date and, for material changes, tell account holders by email at least 14 days before they apply. Continued use after that date means you accept the change. Changes do not affect a package already paid for.
15. Law and disputes
These Terms are governed by the laws of Kenya. If a dispute arises, contact us first and we will try to resolve it within 30 days. Either side may then refer it to mediation, and failing that, to the courts of Kenya, with Nairobi courts having jurisdiction. Consumers keep any right to use the court or tribunal where they live.
16. General
We may transfer these Terms and your account to another organisation as part of a reorganisation or transfer of the Platform; your rights under these Terms are not reduced by such a transfer. If any part of these Terms is found unenforceable, the rest remains in force. These Terms, the Privacy Policy and the description of any package you buy are the whole agreement between us. Notices to us go to enquiries@kenyahomesearch.com; notices to you go to the email on your account.
