Privacy Policy

Version 3, last updated 18 Oct 2026

Last updated: 18 October 2026

This policy explains what personal data Kenya Home Search collects, why, who it is shared with, how long it is kept and the rights you have under the Data Protection Act, 2019 of Kenya. It applies to www.kenyahomesearch.com, its dashboards and the emails and messages we send.

1. Who we are

Kenya Home Search ("we", "us") operates www.kenyahomesearch.com and is the data controller for the personal data described in this policy. You can reach us about privacy at enquiries@kenyahomesearch.com.

2. The data we collect

Account data. Name, email address, phone and WhatsApp numbers, password, the type of account you choose (seeker, owner, agent, agency, property manager or developer), business name and licence or registration number where you give them, and the date you accepted our Terms and this policy.

Listings. The property details, photos, videos, virtual tours, location and map pin, plot outline, price and the contact details you choose to show. Listings are public by design once approved.

Enquiries and requests. When you contact a lister or ask us to find a home, we collect your name, phone, email, message, preferred contact method and viewing date, and the details of what you are looking for. If you use our forms for buyers abroad, we also record the country you live in.

Verification. If you ask for ID, title or owner verification, we collect the documents and details needed for that check, such as an identity document, title or official search results and survey files. These are kept private, are never published and are seen only by the people who carry out the check.

Partners and field agents. If you join our onboarding programme, we collect your contact details, M-Pesa number, KRA PIN, the accounts you refer, what you earn and the payments we make to you.

Payments. For packages and add-ons we record the amount, method, transaction reference and dates. We do not collect or store card details.

Messages with us. What you send through our contact forms, email or WhatsApp, and our notes on handling it.

Usage and device data. Pages viewed, searches made and listings saved, shared or contacted, which we keep as daily totals, together with technical information such as your browser type and the country of your connection. We use the country to show prices in your currency and to understand where our visitors come from.

Where you came from. If you arrive from an advert, a search engine, a social network or an AI assistant, we record the campaign name or the referring website (see section 7). We attach this to your account or enquiry so we can tell which campaigns are useful.

3. Why we use it, and our lawful basis

  • Running your account and publishing your listings: Performing our contract with you

  • Passing your enquiry to the lister you contact, or matching your request with listers: Performing our contract with you, at your request

  • Verification checks you ask for: Performing our contract with you

  • Paying partners and recording payments and invoices: Contract, and our legal obligations including tax records

  • Preventing fraud, spam and abuse and keeping the platform secure: Our legitimate interest in a safe marketplace

  • Counting visits, searches and contacts, and improving the site: Our legitimate interest in running and improving the service

  • Knowing which campaigns and websites bring visitors: Our legitimate interest in measuring our marketing

  • Analytics and advertising cookies from Google: Your consent, which you can withdraw at any time

  • Newsletters and marketing emails: Your consent; every email has an unsubscribe link

  • Responding to lawful requests from authorities: Our legal obligations

4. Who we share it with

Listers you contact. When you send an enquiry or tap to call or WhatsApp, the lister receives your name, phone, email if given, and message. Listers are independent of us and handle your data under their own responsibility.

Other users. Listing details and the contact details a lister chooses to show are public. A lister's email address is shown only when they choose, and only after a visitor taps to reveal it.

Service providers who process data for us under contract, such as our website hosting, network and security, file storage, email delivery and mapping providers. They may use the data only to provide their service to us.

Advertising and analytics partners. Google, for advertising and site statistics, only if we use these services and only after you consent (see sections 7 and 8).

Authorities. We disclose data when the law requires it, for example to the Kenya Revenue Authority, the courts or the police acting lawfully.

Business transfer. If the platform is reorganised or transferred to another organisation, your data may move with it and will remain protected under this policy.

We do not sell your personal data.

5. Transfers outside Kenya

Some of our service providers store or process data outside Kenya. Where that happens, we make sure appropriate safeguards are in place to protect your data, as the Data Protection Act requires. You can ask us for more information about these safeguards.

6. Security

We use appropriate technical and organisational measures to protect personal data against unauthorised access, loss and misuse, and we limit access to the people who need it. If a personal data breach puts your rights at risk, we will notify the Office of the Data Protection Commissioner and, where required, you.

7. Cookies and similar technologies

We use only the cookies needed to run the site, unless you choose to allow more.

  • Session cookie: Keeps you signed in and protects forms (Until you close the browser, or 2 hours of inactivity)

  • XSRF-TOKEN: Needed for forms to work securely (Same as the session)

  • remember_web_...: Keeps you signed in on this device, only if you tick "Keep me signed in" (Until you sign out)

8. Advertising

Sponsored placements. Ads we sell to businesses are shown from our own servers, labelled "Sponsored", and do not use cookies. We count how many times each is seen and clicked without identifying you.

Google AdSense. If we switch on Google ads, Google's advertising scripts load only after you allow advertising cookies. Google may then use cookies to show and measure ads. You can learn how Google uses data at policies.google.com/technologies/partner-sites.

9. How long we keep data

We keep personal data for as long as it is needed for the purposes described in this policy, including providing our services, keeping records, resolving disputes, preventing fraud and meeting our legal, tax and accounting obligations, and as permitted by law. You can ask us to delete your personal data at any time (see section 10); we will do so unless we need to keep it for one of these reasons, in which case we will tell you why.

10. Your rights

Under the Data Protection Act you have the right to:

  • be told how your data is used, which this policy does;

  • access the personal data we hold about you;

  • have inaccurate data corrected;

  • ask us to delete your data, which we will do unless we must keep it for a legal reason;

  • object to processing based on our legitimate interests, and to direct marketing at any time;

  • receive your data in a portable format;

  • withdraw consent at any time, without affecting what was done before.

To use any of these rights, email enquiries@kenyahomesearch.com from the email address on your account. We may ask you to confirm your identity. We acknowledge requests within 7 days and respond within the time the law allows.

If you are unhappy with how we handle your data, you can complain to the Office of the Data Protection Commissioner (www.odpc.go.ke).

11. Children

The platform is for adults. We do not knowingly collect data from anyone under 18. If you believe a child has given us personal data, contact us and we will delete it.

12. Changes to this policy

We will post any update here with a new date. If a change is significant, we will tell account holders by email before it applies, and we will ask for your cookie consent again where the change affects optional cookies.
