Overview

How buying from Germany works

Buyers in Berlin, Frankfurt, Munich or Hamburg are used to a Notar who acts for both sides and a Grundbuch entry that settles everything. Kenya has no shared notary in a property sale. Each side has its own advocate, the buyer's advocate checks the title on Ardhisasa, and ownership passes when the transfer is registered after stamp duty is paid.

Nairobi is one or two hours ahead of Germany depending on the season, so live viewings fit easily into your day. Below are verified listings with an indicative EUR figure next to the KES price, how to send euros safely, and how to give a power of attorney if you cannot travel.

Before you start

The essentials for buyers in Germany

  • Freehold for Kenyan citizens

Kenyans abroad, including dual citizens of Germany, can own freehold land. Non-citizens can hold leasehold of up to 99 years.

  • Title search on Ardhisasa

Your advocate runs an official search to confirm the registered owner and any charges before you sign.

  • Stamp duty 4% or 2%

4% of the value in urban areas and 2% in rural areas, paid through Ardhipay before registration.

  • 45 to 90 days

A typical transfer from signing the sale agreement to registration.

  • Your own advocate

Hire an advocate who works only for you. Never share the seller's or the agent's lawyer.

  • View before you pay

Never pay a deposit or fee before a verified viewing, in person or by live video.

Viewings on your clock

Nairobi runs on East Africa Time (UTC+3) all year. Daylight viewings work best between 10:00 and 16:00 there.

  • Nairobi is 1 hour ahead of Berlin today; the gap moves between 1 and 2 hours when the clocks change. A 10:00 to 16:00 Nairobi viewing is 09:00 to 15:00 in Berlin.

Ask the lister for a live WhatsApp video call rather than a recorded clip: you can ask them to walk the boundary, open taps and show the access road. Kenyans in Berlin, Frankfurt, Munich, Hamburg, Cologne and Stuttgart use our remote viewing checklist to make the call count.

Paying safely from Germany

A SEPA transfer will not reach Kenya; use an international (SWIFT) transfer from your German bank to your advocate's client account and ask your bank about fees and the exchange rate. Check the account details with your advocate by phone before each payment, and never pay a seller or agent directly.

  • Pay by bank transfer into your advocate's client account only.
  • Never send money to an individual, an agent or a personal mobile money number.
  • Never pay before a verified viewing and a clean official search.

Signing without flying home

A power of attorney lets someone you trust in Kenya sign for you. Keep it specific to one property and one transaction. You sign it at the Embassy of Kenya in Berlin or before a notary in Germany, and your advocate then has it stamped and registered in Kenya before it is used. Confirm the exact signing route with your advocate before you book an appointment.

Diaspora mortgages

German banks rarely finance property in Kenya. Some Kenyan banks offer diaspora mortgages based on income earned abroad, recent statements, identification and a deposit. Read the full offer and compare lenders; advertised figures change.

FAQ

Questions buyers in Germany ask

General information, reviewed 17 Oct 2026. It is not legal or tax advice: your own advocate confirms the steps for your purchase.

Ask for verified listings

Can I own freehold land in Kenya while living in Germany?

Yes, if you are a Kenyan citizen, including a dual citizen of Germany. Kenyan citizens can hold freehold title wherever they live. If you are not a Kenyan citizen, the Constitution limits you to leasehold of up to 99 years.

How do I check the title before I pay from Germany?

Your own advocate runs an official search on Ardhisasa, the Ministry of Lands platform, to confirm the registered owner and any charges, and you or someone you trust views the property, verified, before any money moves. Never pay before a verified viewing.

How much is stamp duty and how is it paid?

Stamp duty is 4% of the value for property in urban areas and 2% in rural areas. It is assessed and paid through Ardhipay before the transfer is registered.

How long does a transfer take?

Usually 45 to 90 days from signing the sale agreement, depending on consents, the stamp duty valuation and the land registry.

Do I have to fly home to sign?

No. You can sign a power of attorney so someone you trust signs in Kenya for you. Sign it at the Embassy of Kenya in Berlin or before a notary in Germany, then your advocate has it stamped and registered in Kenya before it is used.

Does a German notary need to certify my power of attorney?

A power of attorney signed in Germany is usually signed before a notary or at the Kenyan embassy and then has to be accepted and registered in Kenya. Ask your Kenyan advocate which route the registry accepts before you sign.

Do I pay tax in Germany on Kenyan property?

Rental income or gains abroad can matter for German tax. Ask a Steuerberater about your own position; we do not give tax advice.
